1. Acceptance of Terms

By purchasing, activating, or using an Eventgrams gallery ("Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Eventgrams LLC, a Colorado limited liability company ("Eventgrams," "we," "us," or "our"). If you do not agree to these Terms, do not use the Service.

2. What Eventgrams Provides

Eventgrams provides a personal digital media gallery linked to a unique QR code printed on event merchandise. Each gallery is activated using a one-time activation code provided at the point of sale. Once activated, your gallery can be accessed by anyone who scans your QR code, unless you set a password.

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Your Account & Activation Code

• Your activation code is single-use and tied permanently to one gallery.
• You are responsible for keeping your gallery access secure.
• Eventgrams is not responsible for unauthorized access resulting from your failure to secure your credentials.
• You may not transfer or resell your activation code.

5. Content You Upload

• You retain full ownership of all photos and videos you upload to your gallery.
• By uploading content, you grant Eventgrams LLC a limited, non-exclusive license to store, display, and transmit that content solely for the purpose of operating your gallery.
• You may not upload content that is illegal, harassing, defamatory, sexually explicit, or that infringes on any third party's intellectual property rights.
• Eventgrams reserves the right to remove any content that violates these Terms, without notice.
• You are solely responsible for the content you upload and share.

6. Storage

• Each gallery includes 5GB of storage at no additional charge.
• Additional storage upgrades are available: 5GB for +$10.00, or 10GB for +$20.00.
• Eventgrams reserves the right to remove galleries that have been inactive for more than 3 years, with at least 30 days' prior notice sent to the email address on file.

7. Privacy & Gallery Visibility

• Galleries are public by default — anyone who scans the QR code can view your content.
• You may add a password to your gallery at any time to restrict access to viewers you choose.
• Eventgrams does not sell your personal data to third parties.
• We may collect basic usage data (such as view counts) to operate and improve the Service.

8. Payments & Refunds

• All purchases, including activation codes and storage upgrades, are final and non-refundable.
• Eventgrams LLC is not responsible for activation codes lost after purchase.
• Pricing is subject to change with reasonable notice posted on the website.

9. Prohibited Uses

You agree not to use the Service to:

• Upload, share, or distribute illegal content of any kind
• Impersonate another person or entity
• Attempt to access another user's gallery without authorization
• Use automated tools to scrape, crawl, or overload the platform
• Reverse engineer or attempt to extract the source code of the Service
• Use the Service for any commercial purpose without prior written consent from Eventgrams LLC

10. Intellectual Property

The Eventgrams name, logo, website design, and platform code are the intellectual property of Eventgrams LLC and are protected by applicable copyright and trademark laws. You may not use them without our prior written permission.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Eventgrams LLC does not warrant that the Service will be uninterrupted, error-free, or that your content will never be lost. We strongly encourage you to maintain your own copies of any photos or videos you upload.

12. Limitation of Liability

To the fullest extent permitted by law, Eventgrams LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid to Eventgrams LLC in the twelve (12) months preceding the claim.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Colorado.

14. Changes to These Terms

Eventgrams LLC reserves the right to update these Terms at any time. We will post the revised Terms on this page with an updated "Last updated" date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify users via the website or email.

15. Copyright Infringement Notices (DMCA)

Eventgrams LLC respects the intellectual property rights of others and expects users of the Service to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond to clear notices of alleged copyright infringement.

If you believe content hosted on Eventgrams infringes your copyright, please send a written notice to our Designated Agent that includes:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material claimed to be infringing, with enough detail for us to locate it (e.g., the gallery URL)
• Your contact information, including your address, telephone number, and email address
• A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
• A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

Our Designated Agent is registered with the U.S. Copyright Office's DMCA Designated Agent Directory. Upon receipt of a valid notice, Eventgrams LLC will remove or disable access to the identified material and, in appropriate circumstances, terminate the accounts of users who are repeat infringers.
